Brood War Tournament Terms of Service Agreement

Brood War Tournament Rules
I will comply with the Brood War Rules of Play and the Battle.net Terms of Service regarding conduct and behavior (which may be modified by Blizzard Entertainment from time to time in its sole discretion). The Brood War Rules of Play are available herein.
Eligibility and Player Information Eligibility
The Brood War Tournament is open to all players of Starcraft: Brood War. To be eligible, a player must earn ten (10) wins in open Starcraft: Brood War play over Battle.net. Employees of Blizzard Entertainment, Davidson & Associates, Inc., and or its parent, their family members, agents, subsidiaries, distributors, advertising agencies and resellers are not eligible to enter. The winners of all major prizes may be required to execute an affidavit of eligibility and release which must be returned to Blizzard Entertainment within a stated time period. In the event that a finalist who wins a prize is a minor, the prize will be awarded to a parent or legal guardian who will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release within fifteen (15) calendar days of date on notification. The Affidavit of Eligibility will require that you provide to Blizzard Entertainment the winner's current valid address and telephone number as well as accurate responses to the limited personal information requested by Blizzard Entertainment and will give Blizzard Entertainment the right to utilize the winner's name, screen name, likeness (including photographs, videotapes, drawings, icons, profiles and caricatures), voice, biographical information, quotes, game competitions, replays, demos, broadcasts and other depictions in connection with the tournament for commercial, business, trade, art, advertising and/or publicity purposes in any medium whatsoever, including tournament results, product packaging and web pages or .html files that are located on the World Wide Web, without any further permission from the finalist.

All Brood War Tournament participants must agree to the Brood War Tournament Terms of Service as well as the Battle.net Terms of Service. All players who participate in the Brood War Tournament must do so utilizing only their designated screen name, and under no circumstances shall a player participate in the Brood War Tournament utilizing another player's screen name.

Players are responsible for all costs, or charges involved in accessing Battle.net and warrant that the cost of accessing Battle.net, if any, is part of a larger agreement with an Internet Service Provider or some other means, and that the cost of this access is not an incremental cost. Players' monitors, computers, software and Internet access must be calibrated to industry standards. Blizzard Entertainment is not responsible for those who cannot access the site, regardless of technical, hardware, software, network problem, delay, failure or malfunction or for any reason.

Blizzard Entertainment is not responsible for illegible, lost, late, misdirected, damaged or incomplete electronic or regular mail sent. The Brood War Tournament is void where prohibited, licensed, restricted or taxed. All taxes are the winner's responsibility. All materials submitted become the property of sponsor and none will be returned. Acceptance of a prize constitutes permission to use winner's name and likeness for advertising and promotional purposes without additional compensation, subject to parental approval, unless prohibited by law.

By participating in this game, you agree to be bound by this agreement.
Membership
I acknowledge that in order to participate in the Brood War Tournament, I must be in the possession of a full copy of Starcraft and Starcraft: Brood War with an authentic Starcraft CD key. In addition, I will comply with the Brood War Tournament Terms of Service, Battle.net Terms of Service and Starcraft: Brood War End User License Agreement.
Brood War Tournament Ownership
I agree that Blizzard Entertainment is the sole and exclusive owner of the Brood War Tournament and Battle.net and any and all elements of the Brood War Tournament, including but not limited to the Blizzard Entertainment brand, trademarks and logos; the Brood War Tournament and competitions; the Brood War Tournament rules, regulations and bylaws; the Starcraft ladder statistics (including player statistics); television, broadcast and other media rights; merchandising and licensing rights; any other aspects or elements of the Brood War Tournament; any modifications or other derivatives to the Brood War Tournament or these elements; and copyright, trade secret and other intellectual property rights therein or related thereto.
Use of the Brood War Tournament or Battle.net Name
I will not use the Brood War Tournament or Battle.net name, brand or logos or any of the Brood War Tournament or Battle.net sponsors' names, brands or logos for any commercial purpose whatsoever without the express prior written permission of Blizzard Entertainment or in any derogatory fashion as determined by Blizzard Entertainment. Furthermore, I will not make any statements on behalf of Blizzard Entertainment or any of the Brood War Tournament Officials or Battle.net sponsors or act in any way as a representative of Blizzard Entertainment, Brood War Tournament Officials or Battle.net or any of the Brood War Tournament Officials or Battle.net sponsors without the express prior written permission of Blizzard Entertainment.
Disqualification
I understand that Blizzard Entertainment, in its sole discretion may (at any time and without notice) disqualify me from any tournament or competition for failure to comply with the terms of this agreement, Brood War Rules of Play, Battle.net Terms of Service Agreement, Starcraft: Brood War End User License Agreement or the rules or the decisions of Blizzard Entertainment.
Liability
I acknowledge that Blizzard Entertainment, Battle.net and the Brood War Tournament sponsors are not liable for, and I release Blizzard Entertainment, Battle.net and the Brood War Tournament sponsors of, any damages arising out of or related to my participation, or my inability to participate, in the Brood War Tournament, the actions of other players, the operation of Battle.net, its tournaments or any other Blizzard Entertainment events, or any of Battle.net decisions, interpretations or rulings.

IN NO EVENT WILL BLIZZARD ENTERTAINMENT OR ANY OF THE BROOD WAR TOURNAMENT OR BATTLE.NET SPONSORS BE LIABLE TO ME FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF MY PARTICIPATION, OR INABILITY TO PARTICIPATE, IN THE BROOD WAR TOURNAMENT, OR ANY OTHER BATTLE.NET RELATED EVENTS, EVEN IF BLIZZARD ENTERTAINMENT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. IN NO EVENT WILL BLIZZARD ENTERTAINMENT, BATTLE.NET, OR ANY OF THE STARCRAFT TOURNAMNET OR BATTLE.NET SPONSORS BE LIABLE FOR ANY DAMAGES.
Final Decisions
I acknowledge that all decisions by Blizzard Entertainment, through Brood War Tournament Officials or other operations personnel, as to the interpretation of the rules, the operation of the tournaments and competitions, the award of prizes and the designation of winners of matches and tournaments are final, and I agree to comply with those decisions.
Regular Season Finals and World Championships Behavior
As a Brood War Tournament finalist, I agree to act in a professional manner at all times. I agree that I will not curse or make derogatory comments about Blizzard Entertainment, the Brood War Tournament or its officials, Battle.net, tournament sponsors or other players.
General
I will comply with all government rules, regulations and laws applicable to the Brood War Tournament, Battle.net competitions and in regard to taxation issues associated with Brood War Tournament prizes and awards. I understand that this agreement is the complete and exclusive agreement between Blizzard Entertainment and myself and supersedes any proposal or prior agreement, oral or written, and any other communications between Blizzard Entertainment and myself relating to the subject matter hereof. This agreement will be governed by the laws of the United States of America.
